This document refers to the privacy policy that applies to both the mobile applications and the MOVIhNG website, hereinafter referred to as MOVIhNG or the Platform.

What kind of data do we collect?

The MOVIhNG platform does not collect any personal data that can be used to identify you. However, as a fitness app, we may collect general data about your profile (age, gender, weight and height) and data about the exercises performed, such as workout time, satisfaction with the program or certain metrics (number of steps, heart rate, oxygen saturation, activity time and/or energy consumed) collected by your mobile and/or wearable devices.

For what purposes do we process your personal data?

We process the information you provide us with the purpose of managing the contractual relationship that binds us, managing the sending of the information you request from us, providing interested parties with offers of our services and/or products of interest, and/or managing your candidacy.

Concretely, this information is useful to us to improve and personalize your experience in the app, contribute to medical research, analyze app performance and usage, resolve technical issues and respond to user inquiries.

The data collected do not personally identify you and will not be shared with third parties.

How long will we keep your personal data?

Your data will be kept for the minimum time necessary for the proper provision of the service offered, as well as to address any liabilities that may arise from it and/or any other legal requirement.

What is the legal basis for the processing of your data?

The legal basis for the processing of your personal data may be the execution of a potential and/or subscribed contractual relationship, legitimate interest, and/or the consent of the data subject. The data we request from you are appropriate, relevant, and strictly necessary, and in no case are you obliged to provide us with them, but their non-communication may affect the purpose of the service or even make it impossible to provide it. You ensure that all the data you provide us with is true, accurate, relevant, and up-to-date for the purpose for which we request it.

To which recipients will your data be communicated?

We will not communicate your data to any third party, unless it is expressly informed of it and authorizes it explicitly, or in those cases provided for by current legislation.

What are the rights of the users?

The Data Controller informs the User about the possibility of exercising their rights of access, rectification, opposition, deletion, portability, and limitation of processing, as well as to refuse automated processing of personal data collected by us.

These rights may be exercised free of charge by the User, and where applicable, the person representing them, by means of a written and signed request addressed to the following address: Avda. Alexandre Rosselló, 23 1. 07002, Palma (Spain).

This request must include the following information: name and surname of the User, address for notification purposes, photocopy of the National Identity Document or Passport, and the request that specifies the request.

In the case of representation, it must be proven by means of a reliable document. Likewise, the User may exercise the aforementioned rights through the email address movihng@gmail.com.

In addition to the above rights, the User will have the right to withdraw the consent given at any time by means of the procedure described above, without such withdrawal of consent affecting the lawfulness of the processing prior to its withdrawal. We may continue to process the User's data to the extent permitted by applicable law.

Likewise, when the processing of the User's personal data is based on legitimate interest, the User may object to it.

The Data Controller reminds the User that they have the right to file a complaint with the relevant supervisory authority, which in Spain is the Spanish Data Protection Agency. However, prior to filing a complaint with the supervisory authority, the User may contact the Data Controller using the email address movihng@gmail.com to solve it.

Additionally, the user can sign up for the Robinson List at www.listarobinson.es: the advertising exclusion system managed by the Spanish Digital Economy Association (ADIGITAL), in which they can express their opposition to the use of their data for sending commercial communications.

Security and updating of personal data

In accordance with the Principle of Proactive Responsibility, we will adopt the appropriate technical and organizational measures to guarantee the confidentiality, integrity, and resilience of personal data. This is to prevent its alteration, loss, and/or unauthorized processing or access, as required by regulations. It is important that you inform us of any changes to your personal data so that we can keep it updated.

Confidentiality

The Data Processor informs you that your data will be treated with the utmost confidentiality by all personnel involved in any phase of the processing. All Levendis employees have signed a confidentiality clause to ensure their security. We will not transfer or disclose your data to any third party, except in cases provided by law or unless you (as the interested party) have expressly authorized us to do so.

From what age can the User access our products and services?

The MOVIhNG platform is not intended for minors under 18 years of age. By accepting this Privacy Policy, the User declares and warrants that they are over 18 years of age.

Intellectual property and website content

The User of the website acknowledges and accepts that all content displayed on the website, and in particular logos, texts, images, photographs, designs, trademarks, trade names, icons, software, or any sign susceptible to industrial and/or commercial use, are the exclusive property of the Data Controller or their respective owners, if applicable. Therefore, you may not reproduce, copy, distribute, make available, transform or modify such content without the prior and express authorization granted by its legitimate owner.

In any case, you can contact us and we will process your request or redirect you to the appropriate place.

The User of the website undertakes to respect the aforementioned rights and to avoid any action that may harm them, with both the Data Controller and the Data Processor reserving in any case the exercise of all legal means or actions available to defend its legitimate intellectual property rights.

• The Data Controller nor the Data Processor will not be responsible for damages of any kind that may be due to:
• the information contained in the Portal (which cannot be considered in any case as professional advice);

• the presence of viruses in the services provided by third parties through the Portal.

The MOVIhNG apps and website may include hyperlinks to other sites that are not operated or controlled by us. Therefore, the Data Controller does not guarantee, nor is responsible for the legality, reliability, usefulness, truthfulness, and timeliness of the contents of such websites or their privacy practices. Before providing your personal information to these websites outside of the MOVIhNG platform, please note that their compliance with data protection may differ from ours.

Social Networks

MOVIhNG is present on LinkedIn, Instagram, and Twitter, with the main purpose of informing about the services it offers, as well as advertising and managing possible job offers, or any other activity or event that it organizes and wants to advertise.

At no time will we obtain personal data from users who interact on these accounts (unless there is express authorization).
